1. Snowmobile Accident Safety Tips – Wisconsin

    Here are some safety tips for the proper operation of snowmobiles brought to you by Welcenbach Law Offices.1) Do not drink alcohol or use drugs. According to Department. of Natural Resources, alcohol was involved in 70% of the snowmobiling fatalities last year.

    2) Always use a helmet. It can significantly reduce the possibility of serious injury or fatality. Make sure your helmet fits properly and is fastened securely. Make sure it was purchased within the last 5 to 8 years as older helmets offer less protection. Always inspect your helmet to make sure it is not cracked or damaged.

    3) Always ride with another person if possible. This way if you are involved in an accident or injury, the other person is able to contact the appropriate authorities. Additionally, if one machine would break down you would not be stranded and would be able to get out of remote locations.

    4) Always dress appropriately and wear layers of clothing in order to stay warm and dry. Your suit should repel both water and wind and keep you ventilated.

    5) Always obey the speed limit and reduce your speed, especially at night.

    6) Always stay to the right. On almost every trail there is two way traffic. You should stay on the right side of the trail and obey all signs and roadways with caution. Never operate your snowmobile on private property unless you have the consent of the owner. You could be liable for trespassing and there may be hidden dangers which you are unaware of.

    7) Try to avoid riding on lakes and rivers, as often times it is difficult to tell if the lake is frozen over completely or whether there may be thinner weak areas where water may be running into the lake from a stream or other water source causing the ice to be thin.

    8) Always let someone know your plans, where you are planning to go and when you are planning to return. This way if you are not back at your scheduled time or shortly thereafter they may be able to call authorities to do a safety check.

    9) It a good idea to carry a safety kit and repair kit. The kit should contain a spare belt, sparked plugs, extra ranches, nuts and bolts, wire jack knife etc…

    Honda will be expanding its airbag recall to now cover nearly 2 million vehicles.

    The expansion includes certain 2001 and 2002 Accord, 2001 to 2003 Civic, 2001 to 2003 Odyssey, 2002 and 2003 CR-V, 2003 Pilot, 2002 and 2003 Acura 3.2 TL and 2003 Acura 3.2 CL vehicles.

  4. How to Chose Safe Christmas Toys

    An article at Consumer Reports indicates how to choose appropriate toys for the holidays to keep kids safe from danger.  For small children, choking is the biggest hazard along with the risk of lead poisoning.

    Also, parents need to pay attention to the age recommendations for toys such as not giving toys to under 10 year olds that need to be plugged in, to remove strings and ribbons and that any toys with cords are less than 12 inches long to prevent strangulation.

  7. Governor Walker signs bill to lower interest rate on Judgments

    Yesterday, Governor Scott Walker signed a bill into law which reduces the interest rate on Judgments from 12% to prime plus 1 %, which is currently 4.25%.

    The Wisconsin Association for Justice opposed the bill and indicated that current 12 percent rate “discourages unwarranted appeals and encourages prompt payment of legitimate claims.”

    The attorneys at Welcenbach Law Offices, S.C. agree with the position of the Wisconsin Association for Justice and believes this legislation will hurt consumers and individuals in our State.

  10. Recent Trial Verdict

    Robert Welcenbach recently was asked to assist a fellow attorney on a pending case.  About two weeks before trial, Mr. Welcenbach took over the lead of the case and then presented the matter to a jury of twelve in Waukesha County.

    The Plaintiff, represented by Mr. Welcenbach, alleged that he had loaned the Defendant $116,500.00 over a four month period.  The Defendant claimed it was a gift and that Plaintiff owed her money because she alleged she provided materials and services to improve the Plaintiffs condo worth about $37,000.00.

    Plaintiff was in his late 70′s and Defendant was in her late 40′s.

    The jury held for the Plaintiff and awarded him the full $116,500.00.  The jury denied the Defendant any of her claimed expenses for materials or labor.

    Mr. Welcenbach was glad he could assist a fellow attorney and help their client obtain the justice he deserved.
